Terms and Conditions for Translation Services

 

 

Terminology:

 

 

Fast Translation UK is a trading name of The Language Corner Limited (Company number 06659763).

 

Fast Translation UK and The Language Corner is used to refer to The Language Corner Limited.

 

"The Client" is used to refer to the individual /company commissioning The Language Corner Limited's services.

 

"The Translator" is used to refer to the individual providing a translation in the normal course of business as per the instruction of The Language Corner Limited.

 

Translation is used to mean the preparation of a translation or any other translation-related task such as revising, editing and proofreading but not copywriting or adaptation.

 

 

Copyright in Source Material, and Translation Rights:

 

The Language Corner Limited accepts an order from The Client on the understanding that performance of the translation task will not infringe any third party rights.

The Client undertakes to keep The Language Corner Limited and/or The Translator harmless from any claim for infringement of copyright and/or other intellectual property rights in all cases.

The Client likewise undertakes to keep The Language Corner Limited and/or The Translator harmless from any legal action, including but not limited to defamation, which may arise as a result of the content of the original source material or its translation.

 

 

Payment:

 

 

Use of the Fast Translation UK website involves payment for small-volume translation work in advance by online payment.

 

48 Hour Completion and Return:

 

Fast Translation UK / The Language Corner Limited is a professional language company. We aim to please our clients and provide a good service. We will try, wherever possible, to return completed translations of up to 500 words, as specified and paid for by the Client,  to the Client within 48 hours of payment / receipt of the document or text to be translated. This 48- hour rule is based on weekday working hours, so a document or text received on Friday afternoon at 2.00 p.m. may not be returned until 2.00 p.m. on the following Tuesday. In many cases, the completed translation will be returned well within 48 hours. The Language Corner Limited shall not be liable for any consequential losses as a result of delay in returning a completed translation.

 

The Online Ordering Process:

 

Fast Translation UK is a "pay as you go" rapid response translation service. For the process to work efficiently, instructions given during the ordering process must be followed to the letter. For example, when asked to copy and paste a certain sentence into the subject line of the email to us at The Language Corner Limited, this must be done as requested. If a client fails to follow the correct procedure, we may be unable to complete the translation properly. Should this be the case, The Language Corner Limited shall not be liable for any consequential losses as a result of delay or inability to complete a translation. 

It is essential that the client checks the number of words carefully before payment. This is easy to do with documents in Word (just "Select All", go to "Tools" and go to "Word Count". If a client sends a document which contains more words than he/she has paid for, Fast Translation UK will take the following steps:

1/ We will email the client to ask whether he/she wishes to pay for the correct number of words and will email through a Paypal invoice for the outstanding amount. 

 2/ Should the client decide not to proceed, we may decide to refund the original payment, minus the Paypal fee for this transaction.

 3/ Should this process mean that the 48-hour completion rule is missed, this shall be deemed to be due to an error on the part of the client, not on the part of Fast Translation UK. As such, we will not be liable for any consequential losses as a result of a delay.

 

 

Confidentiality:

 

No documents for translation shall be deemed to be confidential unless this is expressly stated by The Client. However, The Language Corner Limited and The Translator shall at all times exercise due discretion in respect of disclosure to any Third Party of any information contained in The Client's original documents or the translations thereof without the express authorization of The Client. Nevertheless, a third party may be consulted over specific translation terminology queries, provided that there is no disclosure of confidential material. The Translator shall be responsible for the safekeeping of The Client's documents and copies of the translations and shall ensure their secure disposal.

 

Cancellation:

 

If a translation task is commissioned and subsequently cancelled, reduced in scope, or frustrated by an act or omission on the part of The Client or any third party, The Client shall pay the full contract sum unless otherwise agreed in advance.

 

Liability:

 

A translation shall be fit for its stated purpose and target readership and the level of quality specified. Unless specified otherwise, translations shall be deemed to be required to be of "for information" quality only. The liability of The Language Corner Limited on any grounds whatsoever shall be limited to the invoiced value of the work. The Language Corner Limited will not accept consequential losses beyond refund of the cost of the translation. Miscellaneous: This agreement shall be governed and construed in accordance with the Laws of England and shall be subject to the exclusive jurisdiction of the Court of England. Satisfaction with Services: Any discrepancies must be highlighted within 5 days upon receipt of the translation, otherwise it is considered to be accurate. Discrepancies must be submitted in a manner that accurately demonstrates the nature of the complaint.
